Introduction

These Terms of Service ("Terms") govern your access to and use of the BusPing mobile app and website (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Acceptance of Terms

By downloading, installing, or using BusPing, you confirm that you have read, understood, and agree to be bound by these Terms. If you use BusPing on behalf of another person or organisation, you confirm that you have authority to accept these Terms on their behalf.

3. What BusPing Does

BusPing is a passenger-powered bus reliability app. It helps people check whether a bus is actually coming by aggregating live reports from other passengers at stops. Features include:

• Searching bus routes and stops
• Viewing recent community passenger pings
• Submitting reports about late buses, no-shows, full buses, buses that drove past, and incorrect live times
• Optional saved routes, proof logs, and commute alert preferences (if you create a profile)
• Local sponsored placement cards and in-app advertising

BusPing launches first in the West Midlands and plans to expand to additional areas over time.

5. Eligibility

You may use BusPing if:

• You are at least 13 years old, or the minimum age in your country or jurisdiction to use such services
• You have the legal capacity to enter into a binding agreement under the laws of your jurisdiction

6. Guest Use and Accounts

BusPing's core features — route search and basic passenger reports — are available without creating an account. No login is required for these features.

An optional profile or account may be available for additional features such as saved routes, proof logs, and commute alerts. If you create an account:

• You are responsible for keeping your login credentials secure
• You must not share your account with others
• You must notify us promptly at support@busping.co.uk if you suspect unauthorised access to your account

We reserve the right to suspend or remove accounts that violate these Terms.

7. User Reports and Community Content

BusPing allows you to submit passenger pings and reports about bus reliability. By submitting a report, you agree that:

• Your report is truthful and based on your actual experience at the time
• You will not submit false, misleading, exaggerated, or fabricated reports
• You will not include personal data about other people, offensive content, unlawful content, or harassment in any report or note
• You will not impersonate another person or submit reports designed to manipulate route reliability data
• You will not submit spam, bulk, or automated reports

By submitting a report, you grant The UGC Playbook LTD a non-exclusive, royalty-free, worldwide licence to display, process, aggregate, and use your report as part of the BusPing service, including displaying it to other users as anonymous community information.

We may review, moderate, remove, hide, or limit reports at any time. Repeated misuse of the reporting system may result in limits on your ability to submit further reports.

8. Moderation and Flagging

Users may flag reports they believe are incorrect or abusive using the "Flag incorrect ping" feature. BusPing may review flagged reports and take action where appropriate, including removal.

Our moderation approach may include automated checks, rate limits, device or account-level limits, and manual review. We do not guarantee that all incorrect or abusive reports will be removed, but we take report quality seriously and act on flagged content where we can.

9. Location

Location access is optional. BusPing may request location permission to help show nearby stops and routes more quickly. You can always search manually without enabling location. You can control location access through your device's privacy or location settings at any time.

10. Ads and Sponsored Placements

BusPing is free for passengers and supported by clearly labelled local sponsored placements. This may include:

• Local sponsored placement cards from businesses advertising nearby services

All sponsored cards are clearly labelled. Local advertisers are responsible for the accuracy and legality of their own advertised content. BusPing may refuse, remove, or limit advertiser content at its discretion. BusPing does not endorse or guarantee the services offered by local advertisers.

11. Acceptable Use

You agree not to:

• Submit false, spam, or deliberately misleading passenger reports
• Use automated tools, bots, or scripts to submit reports or interact with the service
• Attempt to scrape, copy, or extract data from BusPing in bulk
• Attempt to hack, reverse-engineer, decompile, or disassemble any part of BusPing
• Attempt to overload, disrupt, or interfere with BusPing's systems or infrastructure
• Use BusPing for any unlawful purpose or in a way that violates any applicable law
• Harass, abuse, or threaten other users or BusPing staff
• Attempt to manipulate community reliability data for any fraudulent or commercial purpose

12. Intellectual Property

All intellectual property in BusPing — including the app design, logo, branding, illustrations, animations, text, copy, and underlying software — is owned by The UGC Playbook LTD or its licensors and is protected by copyright, trademark, and other applicable laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use BusPing for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, sub-license, reverse-engineer, or otherwise exploit any part of BusPing without our prior written permission.

13. Third-Party Services

BusPing integrates with or is available through third-party services. We are not responsible for the content, policies, or practices of these services:

• Apple App Store — distribution of the iOS app
• Google Play — distribution of the Android app
• Analytics and crash reporting providers — app stability monitoring
• Transport data providers or APIs — if and where integrated
• Maps and location services — if and where used to support nearby-stop features

Your use of those services is subject to their own terms and privacy policies.

14. Availability and Changes

BusPing is provided on an "as available" basis. We may add, modify, or remove features at any time. The service may be unavailable from time to time due to maintenance, technical issues, or circumstances beyond our control. BusPing currently covers the West Midlands and plans to expand to additional regions over time. We do not guarantee availability in any specific area.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, BusPing is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, timely, error-free, secure, or that any community report data will be accurate or complete.

16. Limitation of Liability

To the maximum extent permitted by applicable law, The UGC Playbook LTD will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use BusPing, including reliance on community report data, missed buses, or travel disruption.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for fraud, or for death or personal injury caused by negligence. UK and EU consumers retain all statutory rights that cannot be waived by contract.

17. Termination and Suspension

We may limit, suspend, or terminate your access to BusPing if you materially or repeatedly breach these Terms, if we are required to do so by law, or for safety or security reasons. You may stop using BusPing at any time by uninstalling the app. Sections of these Terms relating to intellectual property, disclaimers, and limitation of liability will continue to apply after termination.

20. Governing Law

These Terms are governed by the laws of England and Wales. You agree that the courts of England and Wales will have jurisdiction over any dispute arising out of or relating to these Terms or your use of BusPing, except where applicable consumer protection law in your country entitles you to bring a claim before your local courts.

21. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If changes are significant, we will make reasonable efforts to notify you in the app or by other appropriate means. Your continued use of BusPing after changes take effect constitutes acceptance of the revised Terms.
